Ci.t� o� ORONO <br /> �. <br /> RESOLUTION OF THE CITY COUNCIL <br /> a� NO. 1413 � <br /> � <br /> • � • • � <br /> A RESOLUTION APPROVING THE RELEASE OF PART <br /> OF THE CITY'S FLOWAGE EASEMENT OVER LOT 1, BLOCK 1, <br /> FAZENDIN FOREST <br /> WHEREAS, the owners of Lot 1, Block 1, Fazendin Forest <br /> have requested that the flowage easement granted the City over the�ir <br /> property be confined to the wetland area of their property; and <br /> WHEREAS, said owners, Henry E. Neils and Eva R. Neils, <br /> husband and wife , have agreed to grant the City a flowage easement <br /> over the said wetlands subject to all the terms and conditions of the <br /> previous flowage easement dated May 25, 197� .and filed for record <br /> as Document No. 4497744 , Office of the Hennepin County Recorder• and <br /> WHEREAS, said wetlands have been surveyed and certified to <br /> lie within the West 415 feet of the North 625. feet of Lot 1, Block 1, <br /> � Fazendin Forest; and <br /> WHEREAS, the City Council agrees that this limitation of its <br /> flowage easement would be appropriate. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br /> City of Orono and that the Mayor and City Administrator are hereby , <br /> . authorized to execute and deliver• a quit claim deed over that portion <br /> of the wetlands described in the original flowage easement dated <br /> May 25, 1.:979 upon the execution and delivery by Henry E.
