• <br /> � C�t� o� ORONO - <br /> �� RESOLUTION OF THE CITY COUNCIL .. <br /> � Na [�(, I ( <br /> • <br /> . - . . . <br /> 24 e potential impact caused by the proposed dredging <br /> would adversely impact Lake Minnetonka and its water . <br /> quality, would adversely affect neighboring properties <br /> and. other properties in North Arm Bay, and. would <br /> adversely affect the public generally. - <br /> 25) Issuance or denial of a dredging permit as proposed <br /> is within the jurisdiction and authority of the City of <br /> Orono: <br /> � a) The dredging location is within a Bay of Lake <br /> Minnetonka, which Bay is entirely within and <br /> surrounded by the City of Orono. <br /> b) The dredging location is within the 300 ft <br /> . harbor limits of the City of Orono. <br /> c) Dredging and other lake or shoreland alterations <br /> are addressed in the City's comprehensive plans <br /> adopted in 1974 , in the 1980 flraft Comprehensive <br /> Community Management Plan, : and in the f inal November, <br />, • 1981 , adopted Comprehensive Community Management <br /> Plan, (hereinafter "CMP") . <br />� d) Dredging and other lake or shoreland alterations � <br /> are regulated by City zoning, flood plan and wetlands <br /> management ordinances, including Seetions 31. 700 <br /> and 31. 800 et . seq . � <br /> e) The 1981 permits issued by MCWD and Minnesota DNR <br /> are both subject to compliance with 1oca1 municipal <br /> regulations as speci�ically conditioned therein. <br /> 26) Based on City and DNR policies, and the facts of the <br /> Welsh application, the Council finds ..that dockage, <br /> even dockage in excess of 100 feet long, is the <br /> minimal impact and therefore preferrable solution to <br /> providing navigable access to the Welsh property. <br /> 27) Based on the facts in the record of this application, <br /> the Council �%mds� that denial of a dredging permi.t would <br /> not deny Welsh any riparian access rights since he • <br /> enjoyed such use without dredging, and indeed without <br /> a dock through the 1981 season, and since it has been <br /> demonstrated that a dock could be built to reach <br /> d'eeper navigable water, with or without the necessity <br /> for a dock length variance. � <br /> • <br /> ts of 15� <br />
