This is confirmed by the � � <br /> changing plans dated as late as March, 1982, <br /> seven months after the DNR permit date and <br /> 8 to 10 months after MCWD review. <br /> 11) Welsh ' s stated purpose for dredging is that there is <br /> insufficient water depth to have navigable access to <br /> his property. <br /> a) Welsh' s soundings submitted to the City (Exhibit B) <br /> indicate the following: <br /> Actual Existinq Water Depths � <br /> � below below below actual <br /> , dis.tance given standard May 31, 1982 <br /> - from shore 928. 8 elev 929. 4 e1.ev 929. 79 elev. <br /> ;�r 10-80 ft 2 ft 2.6 ft 3 ft <br /> 100 ft 2� ft 3.1 ft 3� ft . <br /> 120 ft 3 ft 3.6 ft 4 ft <br /> 150 ft 4 ft 4 .6 ft 5 ft <br /> b) No agency including the City, DNR, MCWD or LMCD <br /> specify any given depth as "navigable" . <br /> ' c) DNR regulations do not indicate navigable access <br /> beginning at 4 feet or deeper as represented by <br /> Welsh. Instead, DNR regulations indicate that <br /> 4 feet is the maximum depth considered necessary <br /> for structures to extend lakeward in order for <br /> complete navigable access to said structures. <br /> d) City Planning Commission ' s. findings at their <br /> August 17, 1981, meeting was that the existing <br /> 2% feet of water was sufficient depth for normal <br /> navigation to a 100 ft long dock which could be - <br /> built to conform to all City, LMCD, DNR and MCWD <br /> requirements, and that 22" was the depth required <br /> for the average boat on Lake Minnetonka. Further <br /> Planning Commission information from Marina operators <br /> indicated 2 '-7" to 2 ' -9" was the depth required for <br /> � the majority of "large" boats serviced by Marinas <br /> on Lake Minnetonka. <br /> 4 o f 15� <br />
