f . � . <br /> ��_ • <br /> / � O� <br /> • O O <br /> ��b� - CITY of ORONO <br /> � � <br /> �� Gti' RESOLUTION OF THE CITY COUNCIL <br /> ��SHp4� NO. � s � � <br /> A RESOLUTION GRANTING VARIANCES <br /> � TO MiTNICIPAL ZONING CODE <br /> SECTION 10.03, SUBDIVISION 15 <br /> FILE NO. #01-2708 <br /> WHEREAS, Michael McClelland and Jeanie McClelland, (hereinafter "the <br /> � applicants") are owners of the property located at 2170 Minnetonka Avenue within the City of <br /> Orono (hereinafter "the City") and is legally described as follows: <br /> Lots 4, 5, and 6, Block 8, Monterey on Minnetonka, except the North 12 feet <br /> of said Lots 4, 5, and 6, Hennepin County, Minnesota <br /> (hereinafter "the property"); and - <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> � Minnesota Statutes and the CiTy of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on September 17, 2001, at which time all persons desiring <br /> to be heard concerning this application were given the opportunity to speak thereon; and " <br /> WHEREAS, the applicants applied to the City of Orono for variances to <br /> Municipal Zoning Code Section 10.03, Subdivision 15 to permit a 6' privacy fence to be <br /> constructed within the 50' side yard adjacent to the street setback where a 3 '/2' fence is <br /> permitted. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: � <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File #01-2708. <br /> 2. The property is located in the RR-1B (2 acre) One Family Rural Residential <br /> Zoning District. � " <br /> 3. The Orono Planning Commission reviewed this application on September 17, <br /> 2001 and recommended approval on a vote of 5 to 2 for a variance based upon <br /> the following findings and hardships: <br /> � <br /> Page 1 of 5 <br />
