MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD APRIL 14, 1986 <br />#990 WARD FERREI.L continued <br />Attorney blatz stated that she felt Mr. Ferrell made a <br />knowledgable waiver of attorney and was made aware that <br />he could have delayed the matter in order to have his <br />attorney presenr. <br />Councilmember Grabek questioned if approval of this <br />request would significantly impact the non-sewered area. <br />Assistant Zoning Administrator Gaffron stated that in <br />his opinion, it would not have a significant impact in <br />that particular area. <br />Mayor Butler stated that taking into consideration that <br />the request is for development of three residential <br />units on 2.9 acres in a 2-acre zone; it was moved by <br />Mayor Butler, seconded by Councilmember Adams, to direct <br />staff tc prepare a resolution of denial based on the <br />following: <br />At this point., Mayor Butler again stated that she felt <br />it fair to inform Mi. Ferrell, that before an actual <br />vote and decision is made, he has the option to request <br />tabling of his application in order for his attorney to <br />be present. <br />Mr. Ferrell's response was that he did not think iv. <br />would make any difference because the Council has <br />already made up their mind: <br />1) Extent of variances. <br />2) Known fallibility of septic systems on small <br />lots. <br />3) Denial does not deprive owner's rights to <br />reasonable use as residential property as it stands <br />now. <br />4) Nu hardship to the land justifying request. <br />5) Zoning code demands 2 acres of dry buildable <br />property per parcel wherein this parcel is 2.9 acres <br />overall requesting 3 buildable lots. <br />Motion, Ayes 4, Nays 1. Counciltr mber Grabek voted nay. <br /># 1007 CAPOL T", PP* <br />4701 WEST ;+RANCH ROAD <br />PRELIMINIARY" SUBDIVISION <br />RRSOI.UTI ON 11979 <br />Carol Trapp was present for this matter. <br />It was moved by Councilmember Frahm, seconded by <br />Councilmember Hammerel, to adopt. Resolution 01979 <br />granting Preliminary approval for a plat at 4701 We-.,t <br />Branch Road. Motion, Ayes 4, Nays 0. <br />7 <br />
