The property consists <br /> of approximately 13.1 acres (including Lots 4, 5 and 50' pasture easement). <br /> 3. The Orono Planning Commission reviewed this application on August 20, 2001 <br /> ' and on a vote of 7 to 0 recommended approval of the proposed variances based <br /> upon the following findings: <br /> � A. Applicant's principal residence is located on Lot 5 along with the barn <br /> , and pole shed of approximately 7.3 acres. <br /> B. Applicants own Lots 4 and 5 additionally have a 50' pasture easement <br /> ' over the southerly portion of adjacent Lot 6. The lots have not been <br /> legally combined. <br /> C. The proposed level of use is compatible with surrounding 5 acre "hobby <br /> • farm" neighborhood, and is in keeping with the "Rural Residential" <br /> character and intent of Orono's RR-lA zoning district. <br /> D. The property has been used for horse boarding and instruction as <br /> proposed in this review for over 15 years. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicant and the effect of the proposed variance on the health, safety�and <br /> welfare of the community. <br /> 5. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air nor <br /> . pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicant, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> • Page 2 of : 6 <br />
