0� <br /> O O <br /> A CITY of ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��9kE '0 NO. 46 6 P, <br /> F. Applicants agree to remove 800 s.f. of hardcover from the existing <br /> driveway and parking area within the 75-250' setback. Total hardcover <br /> to be removed from the property is 800 s.f. from the driveway and <br /> parking area, 160 s.f. from the patio and 187 s.f. of landscape plastic for <br /> a total reduction of 1,147 s.f. <br /> G. Variances to permit replacement of the second story are approved with <br /> a finding this project is a remodel and not a rebuild. Less than 50% of <br /> the living space within the existing structure is being removed as part of <br /> the remodeling (No area within an existing basement or crawl space <br /> would be considered as living space). The walls and structure below the <br /> second story removal will remain. <br /> 4. The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments <br /> by the applicants and the effect of the proposed variance on the health, safety <br /> and welfare of the community. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> grants variances to Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, <br /> Subdivision 16 (C) (6) to permit alteration to the foundation and existing residence, including <br /> replacement of the second story of the existing house and refurbishing of the interior of the <br /> main level of the house, within 75' of the OHV& of Lake Minnetonka and average lakeshore <br /> setback; Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16 (L) (1) to permit <br /> replacement of a 360 s.f. patio, where a 520 s.f. patio exists within 75' of the lakeshore; <br /> Page 3 of 5 <br />
