#722 - Ski Tonka <br />January 13, 1983 <br />Page 2 <br />Septic testing has been required but the City has yet to receive <br />the test results. I have been advised by the current owner, Dunn, <br />that testing was being done on Thursday, January 13, 1983. <br />The enclosed survey shows the principal drainfield located to <br />the north and within the boundaries of 4740 Bayside Road. The <br />drainfield meets the required setback of 10' from all lot lin,2s. <br />Issues for Consideration: <br />1. Is there a need for a subdivision of a lot line rearrangement <br />to create a new parcel for combination with the substandard <br />Dunn property? <br />a) Four acres to bring lot size up to code per. ordinance <br />34.742. <br />b) one acre to satisfy minimum lot area standard for rural, <br />unsewered properties. <br />c) Additional area to satisfy alternate septic site demands <br />because a suitable site could not be found within the Dunn <br />property. <br />d) Require no subdivision. <br />2. Should a lot legally divided for sale purposes under one zoning <br />standard and returned to its original owner be subject to common <br />ownership standards? <br />3. Does the length of time the lot was retained by the owners 1974- <br />1978 have any bearing on the issue? <br />4. Does the fact that tht mers were made aware of the common <br />ownership and change i.. zoning prior to sale have any bearing <br />on the case? <br />Review ordinances 31.201, 31.202, and 31.203 for background on <br />common ownership standards. <br />
