Zoning File #987 <br />January 24, 1986 <br />Page 3 <br />Staff Recommendation: <br />1. From a pure: y technical. st.3ndpuint, using the literal definition <br />of average lakeshore setback as stated in 10.22, Subdivi sion 1, the <br />proposed pool encroaches 1-2' into the average setback area. The <br />proposed pool also is behind the extended front lines of the adjacent <br />houses. The pool structure also is proposed to be no higher than the <br />main floor of tr.e home with deck railing above the pool essentially <br />only 4' further lakeward than the existing deck railing. The neighbor <br />to the south will not, in staff's opinion, have any lake view en- <br />croached upon. In staff's opinion, the neighbor to the north will <br />suffer only a minor degree of view encroachment from "side" windows <br />and no encroachment to views from windows on the lake side. The house <br />to the north as it exists is more than 35' further from the lake than <br />the houses on either side of it. It is staf f's opinion that under a <br />literal interpretation of the code, the average setback variance <br />requested is relatively minor. <br />2. The hardcover variance for 39.4% in the 75-250' zc,ne would not be <br />inconsistent with past variances recently granted to similar <br />properties on the lakeshore, especially considering that: <br />a) There is and will be less than 1% hardcover in the first 100' <br />from the lakeshore; and <br />b) There is only about 10-15% hardcover over the area from 250' <br />to 620' on the remain('- of the property. <br />
