MINUTES OF THE REGULAR ORONO COUNCIh MEETING HELD JANUARY 13, 1986 <br />8 JAMES E. MERTES continued <br />didn't feel it was legal or fair. <br />City Attorney Barrett. stated that it was their opinion <br />that Council has the authority to impose this condition <br />per Section 10.08 Subdivision 3 because the applicant is <br />seeking a variance. <br />Assistant Zoning Administrator Gaffron noted another <br />request. for consideration by applicant tc remove a dead <br />willow tree by the lakeshore in addition to removal of <br />the other three willows because they are messy trees, <br />and replace with some other trees. <br />Warren and Christine Bi.elke, 3241 Casco Circle, we� <br />present and stated that they strongly oppose tr <br />building of a house on this substandard lot as do the i.. <br />neighbors. They also expressed concern r: garding the <br />plans for the existing garage on the prop--r`y. <br />Council. advised the Bielke's that they g::.jnt lot area <br />and lot width variances to lots that are similar in size <br />with the neighboring lots. <br />Mr.. Mertes stated that they plan to leave the garage as <br />is but re -side to match proposed house. <br />Councilmember Frahm stated that he would like to see the <br />house plans not just a building envelope. <br />Mr. Mertes stated that they did not want to invest the <br />expense involved in designing a house until the lot area <br />and lot width variances were granted. He assured the <br />Counci 1 that it would conf crm with their code and be a <br />nice house for the area. <br />It was moved by Councilmember Hammerel, seconded by <br />Acting Mayor Adams, to adopt Resolution #1904 approving <br />the variances, amending the drafted resolution to <br />eliminate condition #1 requiring 20' house to house <br />setback; approve the removal of the one dead willow <br />tree; and that the survey would become an exhibit to the <br />resolution.
