The property is unique by the fact the properly has frontage to Lake <br /> � Minnetonka on both the north side and south side. There are two 0-75' <br /> lakeshore setback zones located on the property. • <br /> B. The replacement of the deck and the dog kennel located to the back of <br /> the house would encroach into the average lakeshore setback to the north <br /> side of the property. The average lakeshore setback ordinance is <br /> intended to protect lakeshore views for adjacent properties. � <br /> C. A visual inspection of the property indicates there is no real real lake <br /> access or water to the north side of the property. The north side of the <br /> property functions as a wetland draining towards Lake Minnetonka. The <br /> � north sides of the properties function as bacic yards and have been <br /> developed accordingly. The primary lake views and docks are located <br /> • to the North Shore Drive side of the property. ' ' <br /> D. The retaining wall is being replaced due to the deteriorating of the <br /> . existing railroad ties. The ties are necessary to stabilize the ground <br /> between the driveway and the elevation of the adjacent house. <br /> E. The Planning Commission recommended the applicants construct a <br /> turnaround on the property that would permit a vehicle to maneuver <br /> enough to not require vehicles to back out to North Shore Drive. <br /> 4. The�City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> . granting the variances would not adversely affect traffic conditions, light, air nor . <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the applicants, but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the applicants; and would be in keeping with the spirit and <br /> intent of the Zoning Code and Comprehensive Plan of the City. <br /> 5.
