Lot 6 of the Farview <br />plat is in the lrocess of being sold. The title company advises, with the <br />information received from the new survey (Exhibit A), of an approximate 5' <br />encroachment into the drainage easement. I have met with a representative <br />of the owners' attorney's office to discuss how the current cloud on the <br />title can be corrected. <br />Review Exhibit B, the plat of Farview, specifically the wetlands and <br />the drainage easement line. It was my recommendation that the owners <br />provide an updated survey locating the edge of the existing wetlands and an <br />amended drainage easement line that would now exclude the existing <br />structure. Based on the designation of the wetland edge on the Farview <br />survey, it would appear that the City would have no problem with the <br />existing structure meeting the required 26' setback. My recommendation <br />would be that we present an amended Flowage & Conservation Easement with <br />the amended survey for Council's review and approval. The owners' <br />attorney's office will prepare all the necessary paper work. <br />Please call mE if you have any questions or if }ou would recommend <br />another procedure fcr correcting the encroachment of the drainage easement. <br />Sincerely, <br />- vv-� d .
