The Orono Planning Commission reviewed this application on January 17,2001 and <br /> recommended approval by a vote of 4 to 0. <br /> 4. The Planning Commission made the following findings of fact: <br /> A. The property currently contains existing deteriorating retaining wall systems <br /> at the lakeshore and street side of the property. Replacement of the retaining <br /> walls is necessary to prevent erosion of the steep slopes on the property and <br /> at the lakeshore. � <br /> B. The existing lakeshore retaining walls are located within 30'of the shoreline <br /> but do not extend the full width of the property. <br /> C. Hardcover in the 0-75'zone should not exceed 3,25 8.84 s.f.and no additional <br /> hardcover should be allowed in this zone. <br /> • D. Hardcover in the 75-250'zone should not exceed 7,433 s.f.and no additional <br /> hardcover should be allowed in this zone. <br /> 5. The City Council finds that the conditions existing on this property are peculiar to <br /> it and do not apply generally to other properly in this zoning district; that granting <br /> the variances would not adversely affect tr�c conditions, light, air,nor pose a fire <br /> hazard or other danger to neighboring property; would not merely serve as a <br /> convenience to the applicants,but is necessary to alleviate a demonstrable hardship <br /> or di�culty; is necessary to preserve a substantial property right of the applicants; � <br /> and would be in keeping with the spirit and intent of the Zoning Code and <br /> Comprehensive Plan of the City. <br /> 6. The City Council finds that granting a conditional use permif to allow construction <br /> of a retaining wall system will not to be detrimental to the health, safety or general <br /> welfare of the public, would not adversely affect light, air nor pose a fire hazard or <br /> other danger to neighboring properties, nor will it depreciate surrounding property <br /> values and that the proposed level of use of the property will be in keeping with the <br /> intent and objectives of the Zoning Code and Comprehensive Plan of the City. <br /> 7.
