Gaffron, Assis'_ant 'Zoning Administrator <br />DATE- June 13, 1985 <br />SUBJECT: #929 Lyle Rahn, 1146 W.i.ldhurst Trail - Conditional <br />Use Permit. <br />Zoning District - LR-lB <br />Request - Conditional Use Permit for an existing guest house <br />List of Exhibits <br />Exhibit A - Application <br />Exhibit B - Construction Plan and Request <br />Exhibit C - List of Property Owners <br />Exhibit D - Plat Map <br />Exhibit E - Survey <br />Exhibit F - 1974 Variance Ap..,lication Documents <br />The applicant is requesting a f�)rmal conditional use permit for a guest <br />house located in his lakeshore yard. This structure has existed on <br />the property since prior to 1974 when the applicant purchased the <br />property. This structure was ie only structure on the property whin <br />the applicant bought the property. <br />On April 1, 1974, Mr. Rahn subm t.ted an application to the City for a <br />variance to build a new home on he 0.838 acre lot in a 1.0 acre zone. <br />This variance was subsequently . pproved by Council on April 22, 1974, <br />conditioned on the existing ca)in being removed. <br />Mr. Rahn did not obtain a permi+ for his new home within the one year <br />time limit, and his variance expired. He '-hen in July, 1975, <br />reapplied and was again grantee; a variance on ;:: 28, 1975 under i.he <br />condition that the old structure be removed nin 30 days after <br />occupancy of the new structure. <br />Mr. Rahn subsequently obtainr d a building permit on August 4, 1975, <br />upon which appears the natation "approved by V.C. 7-28-75 conditioned <br />on removal of existing house". The building inspector at that time <br />was Mike Scheller. The house would have been nearing complet;.on about. <br />the time Mr. Scheller retired on January 16, 1976 hence it is likely <br />that no followup ever occurred to verify that Mr. Rahn had indeed <br />fulfilled tt conditions of that approval. <br />In the: spr.. .g of 1985, Tom Jacobs became aware that Mr Rahn t.du already <br />completed some remodeling on the structure, and convinced Rahn that a <br />F^rmit was requird, Jacobs being unaware that the structure was <br />illegally existing. Rahn obtained a permit for $25.50 rased on an <br />$1,800 estimated ronstruction value (no plan review wss required). <br />
