MINUTES OF THE PLANNING COMMISSION MEETING HELD OCTOBER 17, 1983 PAGE 3 <br />#761 DOUGLAS SMITH 11. The conditions do not apply generally to other <br />landor structures in the district and which said <br />land is located. <br />12. the granting of the application is necessary for <br />the preservation and enjoyment of a substantial <br />property right of the applicant. <br />1 {. The granting of the proposed variance will not in <br />anv-ay impair health, safety, comfort, morals, or <br />other respect be contrary to the intent of <br />'.oning Code. <br />14. That the granting of such variance will not merely <br />serve as a convenience to the applicant, but is <br />necessary to alleviate demonstrable hardship or <br />difficulty. <br />Rovegnc, seconded, Vote: Ayes ( 4) , Nays ( 2) . <br />Minority Opinions - Callahan and McDonald - Callahan <br />noted that the 'Tanning Commission is looking at the <br />common ownership issue backwards and the City has ar, <br />ordinance in ef feet that the Commission should follow. <br />Callahan stated that the common ownership issue must <br />be solved before granting a variance. <br />McDonald agreed with Callahan and she noted that there <br />is some neighbor opposition and that the common <br />ownership issue should be solved first. <br />#782 OLE OVERBOE <br />4460 FOREST LAKE LANDING <br />VARIANCE Mr . and Mrs. Overboe were present. Mabusth noted that <br />the applicant is asking for a variance to place a <br />detached garage in their limited front yard. <br />Callahan asked if granting this variance would be an <br />obstacle in the future if they plan on constructing a <br />house on the other lot. <br />Adams moved to approve Ole Overt s request for a <br />variance for a detached garage tobe placed 2' from the <br />given right of way, 15' from the side and 38' from the <br />travelled road based on the following findings: <br />1. Location of house on lot. <br />2. Substandard width 55' existing - zoning district <br />standards asks for 140' of width. <br />3. There is no additional land available. <br />4. The house has existed for 15+ years. <br />
