CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />ATUNICIPAL ZONING CODE <br />SECTIONS 10.03, SUBDMSIONS 9 (D) AND 14 (D) <br />FILE #1806 <br />WHEREAS, Jon and Shirley Billigmeier (hereinafter "the applicants") are the <br />owners of the property located at 2935 Farview Lane within the City of Orono (hereinafter <br />"City") and legally described as follows: <br />Lot 9, Block 1, Farview, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subdivisions 9 (D) and 14 (D) to permit the construction of a tennis <br />court to be located 17' from the street lot line where a 50' setback is required and to be placed <br />in front of the principal structure where no such encroachment is allowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1806. <br />2. The property is located in the LR-1A, Zoning District. <br />3. The Orono Planning Commission reviewed this application on April 19, 1993, <br />and recommended approval of the proposed variance based on the following <br />findings: <br />A The applicants' lot is limited by sloping topography as elevations to the <br />rear of the residence drop off steeply which would require excessive <br />amounts of fill to provide a stable base for the court. <br />Page 1 of 5 <br />r..=ws- <br />
