CITY of ORONO F <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 4 9 2 <br />A RESOL1J1ION APPRO'V1NG THE PLAT OF <br />BAYVIE\V FA.RMS SEC01'1) ADDTT'ION 'i: <br />-FILE NO. 1967 <br />- <br />lVHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the iaws cf the State of Minnesota; and <br />"\:V1IEREAS, the City Councii of the City of Orono has adopted subd1vision <br />regulations for the orderly, economic and safe development of land within the City; and <br />\V1fEREAS, the City Council has considered the application for a subdivision by <br />Rebert S. Olson of 4645 Bayside Road, Irvin T. Geffre of 4665 Bayside Road, and K-P <br />Properties, lnc. represented by Donald R. Peterson (hereinafter "the subdividers "); and <br />1NHEREAS, on Octcber 24, 1994, the City Council approved Resolution No. <br />3:.83 granting preliminary approval for a plat at 4645/4665 Bayside Road; and <br />'WHEREAS, the propeny is located within the RR-lB, Singie Fn.miiy Rural <br />R.esidcmiai Zoning Districr requiring a minimum of 2 acres of contiguous dry buildable lan.J <br />'-'-'ithin each ne\\·iy created lot; and <br />Vl"JIBREAS, the propeny contains a total of approximately 19.5 acres, of which <br />approximately 1.1 acres has been delineated as wetland; 2.nd <br />vVHEREAS, 1he proposed plat contains two iots (designared as proposed Lot 1, <br />Block land proposed Lot 1, Block 2), each containing an existing residence strucrure. proposec! <br />Let 1. Block 1 being 2. 75 acres in area, and proposed Lot 1. Block 2 being 1.94 aci'es in area. <br />Proposed Lot 1, Block 2 technically requires a lot area variance, but will retain o·..vnersh_i.p of <br />an additional O. 07 acre outlot and may gain up to an additional O. 28 acres as noted below, rn <br />order w meet the 2.0 acre minimum lot area requirement; and <br />"\YHEREAS, the septic system serving the residence on proposed Lot 1, Block <br />l is failing and is intended to be replaced. On-site se\vage treatment system site evaluation data <br />indicates that primary and alternate drainfield sites for current and future use are available within. <br />proposed Lot l, Block 1.
