Blatz <br />DATE: October 24, 1985 <br />RE;: Concurrent Detachment and Annexation of Incorporated Land <br />Prior to the 1965 legislative session, there were two <br />metnods by which incorporated property could be detached from a <br />municipality and annexed to another municipality: <br />1. The two affected municipalities had to submit <br />resolutions to the Municipal Board which stated their <br />desire to detach and annex the land; or <br />2. The Municipal Board could initiate proceedings for <br />detachment and annexation of portions of one <br />municipality completely surrounded by another <br />municipality on its own motion or upon the petition of <br />all of the owners of the property in the completely <br />surroundt'd area. <br />During the .1965 session, the Concurrent Detachn«nt and <br />Annexation of Inc_orp.ratnd Land Statute, S414.061, was ended to <br />include a new subdivision which provides for a third ave.iue to <br />detach and annex incorporated property. <br />Subd ';. Property Owner Initiation. <br />Property owners may initiate proceedings for the <br />concurrent detachment of their property from one <br />municipality and its annexation to an adjacent <br />municipality bl a petition signed by all of <br />them. The board shall conduct hearings and issue <br />its order as in the case of consolidations of two <br />or more municipalities under sections 414.141; <br />subdivisions 3 and 5 and 414.09. <br />
