The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this Zoning district.; that gra- ng <br />the variance would not adversely affect traffic coedit -as, <br />light, air nor pose a fire hazard or other dange,. to <br />neighboring properties; would net merely serve as a <br />convenience to the applicant, but is .necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to <br />preserve a substantial property right of the applicant; and <br />would he in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />5. The City Council finds that granting a Conditional Use <br />Permit will not be detrimental to the health, safety or <br />general welfare of the public, would not adversely affect <br />light, air nur pose a fire hazard or other danger to <br />neighboring properties, nor will it depreciate surrounding <br />property values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives of <br />the 'Zoning Code and Comprehensive Flan of the City. <br />5. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Cummission, reports by staff and comments of the applicant <br />and the effect of the proposed use on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City <br />Council hereby grants a Conditional Use Permit per Section 10.28, <br />Subdivision 3(A) and a Variance to a performance standard of that same <br />section to permit construction of a guest apartment for the temporary <br />use of applicant's mother-in-law on a property that consists of .9 <br />acres instead of the required 4 acres subject to the following <br />conditions: <br />] . The guest ap-irtment is approved for the sole use of Mary <br />K. Finn, applicant's mother-in-law, change in occupancy of <br />apartment area must be reported to the City. <br />2. The guest apartment may never be rented. <br />3. This Conditional Ilse Permit shall not be conveyed or <br />transferred to a new owner of the property. <br />Pa-ae � of 4 <br />
