City of ORo'NO <br />RESOLUTION OF THE CITY COUNC-1 L <br />A RESOLUTION DENYING <br />A VARIANCE TO MUNICIPAL ZONING CODE <br />SECTION 10.25 SUBDIVISION 6 (B) <br />PILE #912_ <br />WHEREAS, the City of Orono is a municipal corporation <br />or,anized and existing under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et <br />seq. the City Council of the City of Orono has adopted zoning <br />regui-tions for the protection of the public, health safety and <br />general welfare; and <br />WHEREAS, Gordon. Hedlund (hereinafter "t.he applicant") 'nas an <br />interest in the property legally described as the South 120.00 feet of <br />Lot 13, Hickory Hill, Hennepin County, Minnesota (hereinafter <br />property) within the City of Orono (hereinafter "The Ci--y"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipe.l Zoning Cede Section 10.25 Subdivision 6,(B) to <br />permit the constr— * ion of a principal structure on a property that <br />contains 9,532 s._ r 44% of the required 21,780 s.f. in area in the <br />LR-1C Zoning Distri. and <br />WLERFAS, the City Council has reviewed the appiica�ion; the <br />recomi-nendations of the E4-if` and Planning Commission; the comments of <br />the neiarbors; and the comments and written statements of the <br />app,l i cant . <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />Orono, hereby dei es the requested lot area variance for the properly <br />described abDve eased upon one or more of the following findings of <br />fact concerning :his property: <br />FINDINGS <br />1. As of Januiry 1,.1975, the east half of the property hAs been <br />zone) LR-IC, Lakeshore Residential Zoning District requiring a <br />minimum of 1/2 acre in ar a and 100 feet minimum width. The west <br />half has bt�en zoned ;,P-lP, Lakeshore Residential Zoning District, <br />requiring a minimum of 1 acre in area and 140 feet minimum width. <br />Pased on the least restrictive perforrr.ance standards of the 1/2 <br />acre zoning district, the proposed use of the property as a <br />rrsidentiai or buildable lot would require the following <br />variance: <br />rsge l of 5 <br />
