SUBDIVISION 8, AND <br />SECTION 10.22 SUBDIVISION 2, AND A CONDITIONAI. <br />USE PERMIT PT;R MUNICIPAI. 'ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 - FILE 910 <br />WHEREAS, „ 3mes Hoff (hereinafter "tlie applicant" ) is owner <br />of the property located at 2056 Shadywor,' Road within the City of Orono <br />(hereinafter "City") and 1; ): .;escribed as foil ws: <br />T.e%t S cincl the Southerly half of Lot 7, Gust S, Johnson's <br />Addition, Hennepin County, Minnesota (hereinafter <br />"property"); and <br />WHEREAS, the applicant has made application to the City of <br />Orono for a conditional use permit and valiance- to permit the regrading <br />of the lakeshore yard within the 0-75' protected lakeshore area per <br />Municipal Zoning Code !.ection 10.63 Suhdiv.ision 19, requesting a <br />variance to Section 10.55, Subdivision 6. <br />NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application we reviewed as zoning file #910. <br />2. The property is located in the LR-lC Zoning District. <br />3. The Orono P" inning Commission reviewed this application <br />on May 20, 1_ i, and recommended approval making the <br />following findings: <br />a) Applicant's lakeshore yard will conform better to <br />the neighbors yard and will appear more aesthetically <br />pleasing. <br />b) Proposal will fl , e degree of hazardous <br />condition exi.stihc7 property because of the slope <br />of the land and xil- _in,rove the health, safety, and <br />welfare of the ��F,:I irr ^*'S yard and neighborhood. <br />c) Applicant's la,cesnore yard previously had been <br />filled, and the proposal is to return the grade to nearer <br />its original state, thereby reducing hardship on the <br />curcezt owner for maintenance of the yard. <br />Pages 1 of 4 <br />
