To approve variances for a privacy fence at the present location <br />and at the proposed height would establish a negative precedent in the <br />review of similar applications. <br />A minority vote of one voted to approve the application and based his <br />approval on the following findings: <br />1. Long record of abuse of private property because of access <br />location. <br />2. Applicant's right to enjoy the full use of his property. <br />3. The existing fence creates no view problems for adjacent lakeshore <br />lots. <br />4. The applicant has agreed to relocate his fence so that it is not a <br />hazard to the public and still allow him the enjoyment of his private <br />property. <br />5. The applicant has provided the City with sufficient hardship and <br />unique findings to allow _pprova 1 of the variance without fear of <br />negative precedent setting. <br />Council Action <br />To give staff conceptual direction as to applicant's request and <br />prepare a resolution for formal Council action at your November 12, 1985 <br />meeting. <br />
