City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 2740 <br />A RESOLUTION VACATING <br />UNUSED PORTIONS OF DEDICATED <br />DRAINAGE EASEMENTS AT <br />725 OLD CRYSTAL BAY ROAD SOUTH <br />WITHIN THE PLAT OF FARVINN, <br />SECTION 04, TOWNSHIP 117, RANGE 23, <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1480 <br />WHEREAS, the y of Orono is a municipal corpo:-ation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />Y'HEREAS, on October 27, 1989, Ed and Gertz. Toth filed a <br />petition w:: th the City of Orono reque ting the vacation of <br />portions of drainage easements originF.Ily dedicated within the <br />plat of FARVIEW, said portions to be vacated being legally <br />described as follows: <br />The west 40' of the east 50' of the south 190' of the north <br />200' of Lot 12, Block 1, FARVIEW, according to the recorded <br />plat thereof, Hennepin County, Minnesota. Also: <br />That poilion of drainage easement within Lot 12, Block 1, <br />FARVIEW, lying west of the east 100' and northerly of the <br />southerly 30' thereof. <br />WHEREAS, after due published and posted notice, a <br />public hearing was held before the Planning Commission on <br />November 20, 1989, regarding said vacation and all interested <br />persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the <br />Planning Commission voted to recommend approval of the requested <br />vacation and the Council of the City of Orono finds that said <br />vacation, as proposed, is in keepirq with the public interest in <br />consideration of the following findings: <br />1. The vacation does not affect access to or use of any <br />adjoining property. <br />2. The City has not and does not intend to develop, <br />improve cr use the portions of dedicated drainage easements <br />described above. <br />3.
