Page 3 <br />April 3, 1987 <br />4. Access - the access approved by Hennepin County is to the <br />south of the power pole per the sketch attached. THIS <br />ACCESS MUST BE INSTALLED AT THE TIME OF BASEMENT EXCAVATION. <br />THE EXISTING BERM MAY BE USED NEITHER AS A TEMPORARY <br />CONSTRUCTION ACCESS NOR A PERMANENT ACCESS. Provide the <br />proper culvert as Hennepin County permit requires. <br />5. The City cannot allow you to place any structures (other <br />than driveway) on any portion of thr drainage easements on <br />your property. As we have discussed, the drainage easements <br />do not reflect the actual drainage patterns on the lot. The <br />City will be pleased to entertain any formRl applcation for <br />re -defining those easements into a more suitable <br />configuration if you so desire. <br />Finally, you should be aware that Bollig & Sons commenced <br />excavation on your property without the required permits on March <br />27, 1987. The City stopped that work and ordered the excavator <br />to restore the site to original grades, which he did. We were <br />further concerned to find that he had placed some fill over the <br />south end of the primary drainfield site, and further that he was <br />not aware that the house was to be 15' further south than staked. <br />Our reasons for requiring the excavation to be restored were: <br />a) no permit on file; b) excavation in the wrong location for the <br />house as approved; cl if for some reason a permit was not issued <br />we would have no leverage in getting the site restored; end d) <br />since your excavator noted that the neighbors attorney's were <br />looking at the site earlier in the day, if in fact the neighbors <br />filed an injunction and stopped the work prior to issuance of a <br />permit, it might be many months before the situation is resolved, <br />and we could not allow a hazardous excavation to be in place for <br />an indefinite period. <br />The City has no obligation to enforce the covenants of the <br />Farview Association, and our actions to date have proceeded <br />independently of any aci.ion they may be taking. We find that <br />under the conditions noted above, your application generally <br />meets the City requirements for obtaining a building permit for <br />the property. Therefore, a building permit will be issued upon <br />your acknowledgment of and agreement to comply with the <br />conditions noted in 1. through 5. above. Permit fee is as <br />follows: <br />Building Permit $ 720.50 <br />State Fee 107.50 <br />Plan Review 468.33 <br />Investigation Fee (Pena:(cy) 720.50 <br />TOTAL $2,016.83 <br />
