Agreement. The LLRC shall agree to make no claim against the City its officers, employees or <br />agents for or on account of any personal injury, loss or damage to any property, including theft. <br />The City is not responsible for theft, damages or injuries to LLRC property located at the OPWF <br />pursuant to this Agreement. <br />10. Damage. LLRC shall be responsible for damage to the Designated Area or any other areas <br />of the OPWF by any of its officers, members, agents, guests, invitees and volunteers. This includes <br />any and all damages to, including the loss of, the building, furniture, equipment, fixtures, grounds, <br />or any other property, real or personal, owned, used or operated by the City, due to any act or <br />omission of the LLRC or its officers, members, agents, guests, invitees and volunteers. <br />11. Vehicles/Parking. LLRC will not park or allow the parking of any vehicles overnight in the <br />OPWF lots without permission from city staff. <br />12. Reporting of Injuries and Damage. LLRC shall immediately notify the city of the following: <br />(a) any injuries requiring medical attention; <br />(b) any damage to property located in the Designated Area or Additional Rooms used <br />by the LLRC; and/or <br />(c) any other condition that may affect the safe and orderly operation of the <br />Designated Area. <br />13. Improvements. <br />A. The LLRC shall not make any exterior or structural alterations or any non-structural <br />interior alterations to fixtures, walls or other physical structures in the Designated Area without <br />first obtaining the written consent by the City. Any alterations to fixtures or structure must <br />comply with all applicable government laws and regulations. All ideas for improvements shall be <br />brought to the attention of the Parks Superintendent. <br />B. The LLRC agrees not to permit to be created or to remain undischarged any lien, <br />encumbrance or charge arising in whole or in part out of any work or work claim of any contractor, <br />mechanic, laborer or material supplied by a vendor to the LLRC at the OPWF which might be or <br />become a lien or encumbrance upon the city property. <br />14. Signage. Any LLRC signage and message screens the OPWF must be approved by the City <br />prior to installation, which approval or denial will be in the sole discretion of the City. <br />15. Access to OPWF and Designated Area. <br />A. The LLRC Director will be provided (3) key fobs for access to the OPWF and a hard <br />key for access to the Designated Area. It is the responsibility of the LLRC to open and close the <br />Designated Area Monday -Saturday. If a problem arises, the LLRC must schedule opening and <br />closing access to the Designated Area with OPWF staff.
