Article 11. LEAVES OF ABSENCE <br />Depending upon an employee's situation, more than one form of leave may apply during the same <br />period of time (e.g., the Family and Medical Leave Act is likely to apply during a workers' <br />compensation absence). An employee will need to meet the requirements of each form of leave <br />separately. Leave requests will be evaluated on a case -by -case basis. <br />Except as otherwise stated, all paid time off, taken under any of the city's leave programs, must be <br />taken consecutively, with no intervening unpaid leave. The city will provide employees with time away <br />from work as required by state or federal statutes, if there are requirements for such time off that are <br />not described in the personnel policies. <br />Section 11.01 Earned Sick and Safe Leave (ESST) <br />Earned Sick and Safe Leave is authorized absence from work with pay, granted to qualified employees. <br />Employees are to use this paid leave only when they are unable to work for medical reasons and under <br />the conditions explained below. Sick and Safe Leave does not accrue during an unpaid leave of absence. <br />• Full-time employees will accrue Sick and Safe Leave by pay period at a rate of ninety-six (96) hours <br />per calendar year (3.69 Hours/pay period). <br />• Part-time employees regularly scheduled to work will earn Sick and Safe Leave at one hour of <br />Earned Sick and Safe for every 30 hours worked by an employee, up to a maximum of 48 hours of sick <br />and safe leave per year. The maximum total amount of accrued Sick and Safe Leave cannot exceed 80 <br />hours. The hourly rate of Earned Sick and Safe Leave is the same hourly rate an employee earns from <br />employment with the city. To qualify for Sick and Safe Leave an employee must work at least 80 hours <br />in a 12-month period for the city. <br />• Temporary and seasonal employees will earn Sick and Safe Leave at one hour of Earned Sick and <br />Safe for every 30 hours worked by an employee, up to a maximum of 48 hours of sick and safe leave <br />per year. The maximum total amount of accrued Sick and Safe Leave cannot exceed 80 hours. The <br />hourly rate of Earned Sick and Safe Leave is the same hourly rate an employee earns from employment <br />with the city. To qualify for Sick and Safe Leave an employee must work at least 80 hours in a 12-month <br />period for the city. <br />• Paid on call firefighters will not earn Sick and Safe Leave effective May 25, 2024 due to Law <br />Changes. For reference visit MN Dept of Labor. <br />• Sick and Safe Leave may be used only for days when the employee would otherwise have been at <br />work. <br />• Full Time and Part -Time employees will not be allowed to have more than 960 hours (120 working <br />days) of Sick and Safe Leave on January 1st of each year. Once an employee accrues 960 hours, they <br />will not accrue additional time unless the number of hours drops below 960. Accrued Sick and Safe <br />Leave with pay has no value upon termination or retirement except as provided in the "Severance Pay <br />at Retirement / Termination of Employment in Good Standing / Sick and Safe Leave Handling at <br />Termination" section of this handbook. <br />Page 33 of 151 <br />129 <br />
