i�- . <br /> . �� �� . <br /> � o o � <br /> ��b. - � CITY of ORONO <br /> � ' � <br /> '�' RESOLUTION OF THE CITY COUNCIL <br /> ��`9k'E p4'�'� NO. �� 'l�' � �` <br /> �SII <br /> A RESOLUTION GRANTING A VARIANCE <br /> TO MUNICIPAL ZOIVING CODE <br /> SECTION 10.22, SUBDIVISION 1(B)AND <br /> SECTION 10.56, SUBDIVISION 16 (C) (6) <br /> � FILE NO. 02-2750 <br /> WHEREAS,Edward Winer and Michelle Winer, (hereinafter"the applicants")are <br /> owners of the property located at 2010 Shoreline Drive within the City of Orono (hereinafter "the <br /> City") and legally described as follows: <br /> See Attachment A <br /> WHEREAS,the applicants have applied for a variance to Municipal Zoning Code <br /> Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16 (C)(6)to allow encroachment <br /> . of 10' into the average lakeshore setback to permit an addition and deck to be constructed; and � <br /> WHEREAS, after due published notice and mailed notice in accordance with� <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on February 19, 2002, at which time all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File#02-2750. <br /> 2. The property is located in the LR-lA, Single Family Lakeshore Residential Zoning <br /> � District,where 87,120 s.f. or 2 acres is the minimum required lot area. The property <br /> consists of approximately 59,623 s.f. or 1.37 acres. <br /> � 3. The Orono Planning Commission reviewed this application on February 19,2002 and � <br /> recommended approval of the proposed variance based upon the following findings: <br /> '! Page 1 of 7 <br />
