PERMIT PER <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILF 1965 <br />WHEREAS, John S. Pillsbury, Jr. (hereinafter "the <br />applicant") is the owner of the property located at 1280 Bracketts <br />Point Road within the City of Orono (hereinafter "City") and iegaily <br />described as follows: <br />That part of Lot 3, Rearrangement of Orono Point, according to <br />the recorded plat thereof, lying Southerly of the following <br />described line and its extensions: Commencing at the Southwest <br />corner of said Lot 3; thence North, along the Pest line of said <br />Lot 3 to the Northwest corner thereof, being the point of <br />beginning of the line being described; thence Southeasterly, at <br />an angle of 64 degrees 33 minutes 30 seconds with the West line <br />of said Lot 3, to the shore of Lake Minnetonka and there <br />terminating; (hereinafter "property"); and <br />WHEREAS, the applicant has made application to the City of <br />Orono to permit excavation and regrading of 190 yards of fi..1 within <br />the 0-75' iakeshore setback zcne and placement of 190 yards of fill <br />within a Flood Plain area, areas where no cutting or filling are <br />norma i l y a l lowed. <br />Minnesota: <br />NOW, THEREFORE, BE IT RFSOLV ED ty the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #965. <br />2. The property is located in the LR-lA Single Family Lakeshore <br />Residential Zoning District. <br />3. The property is approximately 1.8 acres in area. <br />4. The Orono Planning Commission reviewed this application on <br />September 16, 1985, and recommended approval of the proposed <br />variance and conditional use permit to allow placement of fill <br />and removal of fill within the 0-75' lakeshore setback area where <br />no excavation or placement of fill is normally aiiowed; and <br />recommended approval of the conditional use permit and variance <br />to allow placement. of fill within the Flood Plain area where no <br />filling is normally ailowed, ba-,ed on the following findings: <br />E'age I of 4 <br />
