City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />2. The property is located in the RR-1B Single Family <br />Rural Residential Zoning District. <br />3. The Orono Planning Commission rev 2wed tr-'_s application <br />on September 16, 1985, and recommended a, :vai of the <br />proposed variance based upon the following f .�ngs: <br />A) The applicant is legally operating this golf course <br />under a Conditional Use Permit granted September 9, <br />1968. <br />B) The Municipal Zoning Code allows accessory <br />structu !s as part of a Conditional Use Permit as long <br />as such structures are at least 50' from all property <br />lines. Applicant has stated the proposed structure <br />will be located to meet this setback. <br />C) The structure is proposed to be used for storage of <br />golf course materials and equipment. <br />4. The area of the property is in excess of 12P acres. <br />5. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />6. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would rot merely serve as z. <br />convenience :.o the applicant, but is necessary to al lei iatc <br />a demc.istrable ha_,Ish.*-p or difficuity; is necessary to pi -- <br />serve a substantial operty right of the applicant; and <br />would be in keepinc h the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council; <br />hereby grants a variance to the Municipal %:oning Code Section <br />10.03, Subdivision 9 (C) to permit the construction of an <br />accessory storage structure comprising a total of 2240 square <br />feet of floor area (two f loors at 1120 Square feet each) whc,-,, <br />maximum floor area of 1000 square feet is normally ruq,,l <br />subject to the following conditions: <br />e age 2 of 4 <br />
