The Council further finds that it would be unwise, improper and <br />unjust to allow individual development to occur during this study <br />period to avoid discrimination and unfair advantage to a few to <br />the detriment of the entire City. Therefore, the Planning <br />Commission's discretionary authority to grent permits or approve <br />applications described herein shall not be exercised during the <br />limited term of this ordinance. <br />SECTION 2. Restrictions on the Granting of Permits and <br />Applications. No building permits for new construction or tots <br />reprep aunt, land subdivision applications, rezoning applications, <br />conditional or special use permits, variances or other authority <br />for additional development in the Highway 12 Corridor Area <br />described in Section 4 shall be granted for any purpose which <br />would be inconsistent with the intent of this ordinance, including <br />but not limitei to: <br />Single Family Dwellings; <br />Duplexes; and <br />Commercial Development of any sort. <br />SECTION 3. Ezce lions. Because of the Highway 12 <br />Corridor location and nature xisting development in the <br />restricted area, the City Council hereby grants blanket exception <br />and variance from the provisions of this Moratorium to allow <br />issuance of building permits for <br />the following work, finding after extensive review and study that <br />such limited exceptions would not adversely affect the status quo, <br />and would therefore not be contrary to the intent and purpose of <br />this Moratorium: <br />Building Permits for interior remodeling and <br />renovation of existing dwellings or existing <br />residential accessory structures; <br />B. Building Permits for new residential accessory <br />structures or additions to existing residential <br />accessory structures except that no variances <br />shall be permitted; <br />Building Permits for interior remodeling and <br />renovation of existing commercial buildings or <br />accessory structures. <br />SECTION 4. Restricted Area. That portion of the City <br />of Orono that shall be subject to the restrictions of this <br />Ordinance is all the land... <br />(insert legal description) <br />-2- <br />
