City of OR,ONO <br />RESOLUTION OF THE CITY COUNCIL <br />f�y <br />ETIVG <br />f 1, <br />A RESOLUTION GRANTING t 3 1t�S <br />A CONDITIONAL USE PERMIT PER <br />MUNICIPAL ZONING CODE I TY Orr <br />OI;®�O <br />SECTION 10.03, SUBDIVISION 19 <br />FILE #852 <br />WHEREAS, William Gregory and Stanley Gregory (hereinafter <br />"the applicants") are the owners of the property located at 1410 <br />Shoreline Drive within the City of Orono (hereinafter "City") and <br />legally described as Lot 1, Block 1, Dragonfly Hill (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit to permit the installation of a decorative pond <br />per Municipal Zoning Code Section 10.03, Subdivision 19. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #852. <br />2. The property is located in the LR-lA Lakeshore Residential <br />Zoning District. <br />3. The applicants original conditional use permit application <br />involved both the installation of a decorative pond and the major <br />alteration of a designated wetlands to create a wildlife pond. <br />4. The applicants have asked to separate the Citv's review of <br />the decorative and wildlife ponds in order to expedite the <br />resolution of the decorative pond project requiring less review <br />time and allow the installation of the pond in early fall. The <br />wildlife pond project is more complex requiring additional review <br />time. <br />5. The decorative pond (80'x80') will be constructed within a <br />low area of approximately 3/4 of an acre in area that functions <br />as a seasonal retention area for a localized watershed of appro- <br />ximately 2 to 3 acres. <br />6. In 1982, the City approved a subdivision of the property that <br />conditioned approval on obtaining a conservation and flowage <br />easement over the 3/4 acre flat retention area. <br />Page I of 4 <br />
