City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISION 1 (B) <br />PILE #949 <br />WHEREAS, Gerald Anderson (hereinafter "the applicant") <br />is the owner of the property located at 4495 North Shore Drive <br />within the City of Orono (hereinafter "City") and legally des- <br />cribed as follows: <br />Lot 7 "Bergquist's Addition to Saga Hill, Hennepin County, <br />Minnesota" (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a <br />variance to Muni-ipal Zoning Code Section 10.22, Subdivision 1 to <br />permit the construction of a room addition and deck which <br />encroach into the average lakeshore setback area. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #949. <br />2. The property is located in the LR-lB Single Family <br />Lakeshore Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on August 19, 1985, and recommended approval of the proposed <br />variance based upon the following findings: <br />A) The house addition will encroach 9' into the <br />average house setback area; the deck will encroach 19' <br />into the average deck setback area. <br />B) Applicant has shown his proposal to the neighboring <br />property owners who have voiced no objection to the <br />proposal. <br />C) The proposal does not require any other variances <br />and meets the hardcover requirements of the City. <br />4. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />Page 1 of 4 <br />
