July 3, 1985 <br />Ms. Mabusth <br />Page 4 <br />These proposed setbacks are based on the following reasons: <br />- To move the pool aq far out of the 75 foot lakeshore setback as <br />possible and out of the 50 foot DNR setback. <br />- To maintain a 10 foot or more setback adjacent_ to the house/ <br />greenhouse for as much distance as possible. <br />- The desire to have a pool of 21 feet in width which helps the <br />safety concern of people, especially children, dieing from the <br />short side of the pool. <br />Emergency access can be accomplished to the east, south and west <br />the pool easily and within the 13 foot setback on the north of the <br />pool adjacent to the building entry/exit points. Again, the only <br />restriction will be for a 16 foot wide area by the greenhouse. The <br />pool can also act a convenient water reservoir for fire protection. <br />In summary, the site, zoning qulstions and construction requirements have <br />offered limitations to site u,i,ization. The required locations for the <br />septic system necessitated moving the pool and created a hardship in <br />finding an acceptable alternative location on this restricted site. These <br />conditions of hardship include steep topog:*,phy, narrow area west of the <br />house, existing vegetation and general unique character of the property in <br />relationship to required zoning setbacks. The proposed po-.)1 use is <br />permitted within the LR-1A district. The proposal will not alter the <br />character of the locality.
