PAGF: � <br />1944 LEAR <br />continued <br />City Administrator Bernhardson explained the applicant's <br />request for an after -the -fact variance for a landscaping <br />fence placed 2' from right-of-way. <br />Zoning Administrator Mabusth stated that the fence is 40' in <br />length and 6' high and creates no hazards or view problems. <br />Mabusth referred to Mr. Lear's letter which listed many <br />reasons for the fence, among them, the fence acts as a <br />deterrent for children and pets running out into the street <br />and blocking the view of an unkept park. <br />Mr. Lear submitted some pictures of the fence and area for the <br />Council to review. <br />Mayor Butler stated that the unkept park across the street in <br />in that condition due to the conditions made when the park was <br />donated to the City. Mayor Butler felt that the answer to Mr. <br />Lear 's problem with the fence would be cut of the top 2-1/2' of <br />the fence to conform with the ordinance. <br />Mr. Lear stated that his intent was to use the area for his <br />kids soccer play and that a 6' fence acts as more of a safety <br />deterrent than a 3-1/2' fence. Mr. Lear feels there is a <br />traffic problem in that. area. <br />Mr. Robert Swanson indicated his confusion as to why a 6' <br />fence is not allowed but a 6' hedge of bushes is allowed. He <br />also felt that the fence was aesthetically a plus. <br />Councilmember Frahm stated that by allowing the applicant to <br />retain his 6' fence would be setting a precedent for the <br />entire neighborhood wanting 6' fences. <br />Mr. Lear stated that he felt the fence would also deter the <br />vandalism that he has been recently incurring. <br />It was moved by Mayor Butler, seconded by Councilmember <br />Adams, to instruct staff to draft a resolution indicatii,g <br />denial of the request due to no pertinent hardship.
