The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Commission, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council <br />hereby grants a variance to the Municipal Zoning Code Section <br />10.22, Subdivision 2 to permit the construction of a garage <br />addition with concurrent removal of existing hardcover resulting <br />in no net increase of hardcover on the property, subject to the <br />following conditions: <br />1. Applicant shall remove an area of hardcover in an amount <br />equal to the amount of additional hardcover to be added with <br />the garage proposal (150 square feet). In addition, at such <br />time that the proposed driveway backup apron is constructed, <br />an amount of existing hardcover equal to the hardcover added <br />at that time (approximately 300 square feet) shall be re- <br />moved. At no time shall the total hardcover on the property <br />exceed the amount of hardcover existing at the date of this <br />variance approval. <br />2. The applicant is placed on notice that the existing <br />hardcover on 7/22/85 is 2347 square feet or 25.61 in the 0- <br />75' zone where 0• is normally allowed and 4640 square feet <br />or 41.8% in the 75-�:50' zone where only 25% is normally <br />allowed, and that future proposals for additional hardcover <br />may not be approved and might be approved only with con- <br />current removals of existing hardcover. <br />3. The applicant is placed on notice that the existing <br />boathouse structure in the 0-75' zone is considered a non- <br />conforming structure and is subject to the pertinent <br />ordinances. <br />
