City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING A VARIANCE TO <br />MUNICIPAL ZONING CODE SECTION <br />10.02.65 and SECTION 10.03 SUBDIVISION 18(B) <br />FILE 1938 <br />WHEREAS, Robert Nash (hereinafter "the applicant") is owner <br />of the property located at 1020 Townline Road within the City of Orono <br />(hereinafter "City") and legally described as follows: <br />The South 6 acres of the West 1171.5 feet of the <br />Northwest quarter of the Southwest quarter of the <br />Section 30, Township 118 North, Range 23 West of <br />the 5th Principal Meridian; subject to an easement <br />for road purposes over the west 33 feet thereof; and <br />WHEREAS, the applicant has applied to the City for a variance <br />to Municipal Zoning Code Section 1f.02.65, and Section 10.03, <br />Subdivision 18(B), to permit the construction a horse barn 10' from the <br />side lot line where a 150' setback is normally required. <br />NOW, THEREFORE BE IT RESOLVED by the City COLncil of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as zoning file N938. <br />2. The property is located in the RR-lA Single Family Rural <br />Residential Zoning District. <br />3. The Orono Planning Commission reviewed this application <br />on July 15, 1985, and recommended, approval of the proposed <br />variance based upon the following findings: <br />a) This property and that to the immediate north are 5- <br />acre lots in a 5-acre zone and are not subdividable under <br />current zoning regulations. <br />b) Both this property and that to the north have <br />established residences and both are currently <br />maintaining a limited number of horses, which is an <br />established and allowed use for the properties. <br />c) The properties to the east and south are undeveloped <br />and the proposed barn. will be located more than 150' from <br />these lot lines. <br />f'agc I of 4 <br />
