The applicant is not comfortable with giving up riparian <br />rights for the north property at this time. <br />3. Most of the area north of the lagoon appears on our maps <br />as designated wetland. <br />Considering the applicant's hesitance to accept the limiting <br />conditions now when he is not proposing any subdivision, staff <br />would suggest that Finding 4 and Coaditions 5, 6 and 7 be removed <br />and the following wordinq be added above the Findings on page 1 <br />of the resolution. <br />"and, Whereas, the Council has reviewed this proposal and <br />notes that if a subdivision was proposed under current sub- <br />division regulations, approximately 0.3 acres of wetland north of <br />the lagoon would be required to remain within the boundaries of <br />the ks : Iding lot in order to maintain the 1 acre area require- <br />ment; !-.,aving approximately 0.7 acres zoned LR-IC-1 north of the <br />lagoon, of which acreage the major pertion is designated wetland <br />accordir:y to City maps, hence any future proposed development of <br />land north of the lagoon would meet with strict building limita- <br />tions as to the allowable intensity of use." <br />The resolution can be redrafted as you see fit and brought <br />back to the August 26th meeting. <br />
