City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION ORDERING ABATEMENT OF <br />HAZARDOUS BUILDING ACTION AT BIG ISLAND <br />VETERAN'S CAMP - BOAT HOUSE AND GUARD HOUSE <br />WHEREAS, the City of O:clo is a municipal corporation <br />orga•iized afid existing under the lawE of the State of Minnesota; and <br />WHEREAS, Board of Governers-Big Island Veterans Camp,c/o <br />Order of the Purple Heart, 208 Veterans Service Building, St. Paul, MN <br />55155, has an interest; and <br />WHEREAS, State of Minnesota, Centenial Building, St. Paul, <br />Minnesota 55102, is the fee owner of record of property located at Big <br />Island Veteran's Camp, Orono, Minnesota, herein referred to as Big <br />Island Veteran's Camp, and legally described as follows: <br />Lot 2 Unplatted 23-117-23 21 0001 <br />WHEREAS, the City Council of the City of Orono, having duly <br />considered the matter pursuant to Minnesota Statutes Sections 463.15 <br />to 463.261, hereby finds that the above described boat house and guard <br />house is unr. :table and contains unsanitary and hazardous conditions <br />which constitute a public nuisance and which makes this property <br />hazardous to the public health, safety and welfare based on the <br />following findings: <br />1. Foundation is crumbling on the south wall of boat house. <br />2. <br />Large garage doors <br />falling from boat house <br />building. <br />3. <br />Boat house building <br />is leaning and appears as <br />if it will <br />fall <br />over. <br />4. <br />Electrical wiring in <br />boat house and guard house <br />is in a <br />state of disrepair <br />and is a potential fire <br />hazard. <br />5. <br />Guard house has improper <br />footings and is in <br />a state of <br />deterioration. <br />C. Thy surrounding ,rf.a around the buildings contains high <br />weeds and brush which creates a fire hazard. <br />7. Buildings are in a state of deterioration and <br />dilapidation, thus it is a safety and health hazard <br />pursuant to Minnesota State Building Code/Uniform <br />Building Code, Section 203. <br />8. Orders to remove the structures were issued by the <br />Building Official on August 31, 1984, and May 22, 1985. <br />These orders have not been complied with. <br />9. Structure is a non -conforming use and has deteriorated <br />over 50% of the estimated value per Orono Ordinance <br />Section 10.03 Subdivision 5 W, Structure must be <br />r •-. muv ed . <br />
