City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION BY THE CITY OF ORONO SETTING A SPEED <br />MIT OF 30 MPH ALONG WILLOW DRIVP. NEAR PDX STREET AND <br />INDEMNIFYING THE MINNESOTA DEPARTMENT OF TRANSPORTATION <br />FROM ANY CLAIMS AS A RESULT OF <br />SETTING SUCH SPEED LIMIT <br />WHEREAS, the Minnesota Department of Transportation <br />(Mn/DOT) has approved and granted to the City, a variance from <br />Minnesota Rules S8820.3300 allowing a vehicle speed limit of 30 mph on <br />Willow Drive, near Fox Street; <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the <br />City of Orono: <br />1. The vehicle speed limit along Willow Drive near Fox <br />Street shall be set at 30 miles per hour, rather than 40 miles <br />per hour as stated in Minnesota Rules S8820.3300. <br />2. As a condition of Mn DOT g.Lanting its variance, the City <br />will hold harmless the State of Minnesota and all its agents <br />and employees of and from any and all claims, demands, <br />actions or causes of actions of any nature or character <br />arising out of or by reason of , in any manner, the resurfacing <br />project on MSAS 101 (Willow Drive) from Fox Street to <br />B.N.R.R. Bridge, in any other manner than as a design speed of <br />40 miles per hour in accordance with the Minnesota Rules <br />S8820.3300, and further agrees to defend at their sole cost <br />and expense any action or proceeding commenced for the <br />purpose of asserting any claim of whatsoever character <br />arising as a result of the variance. <br />Adopted by the City Council of the City of Orono, Minnesota, <br />at a regular meeting held August 12, 1985. <br />ATTEST: <br />Dorothy M.
