Because this is the RR-lB zoning dis- <br />trict, and this is technically a corner lot (even though both <br />roads are undeveloped), enclosing the entryway constitutes an <br />encroachment into the required 50' street setback zone (Section <br />10.28, Subdivision 5 (B) ). Remember that a stoop or deck which <br />extends no higher than the main floor level is not an encroach- <br />ment per Section 10.03, Subdivision 14 (C). Unfortunately for <br />the applicant, enclosure of this existing non -encroaching stoop <br />is an encroachment requiring a variance. <br />You will recall that the Minnetonka Bluffs is an area of <br />historic dense development which was sewered in 1980 but was not <br />rezoned to reflect the actual lot sizes, hence many projects of <br />this type would require variances in this neighborhood. <br />The applicant obviously has a hardship in that the lot is <br />only 130 'x150' and the existing house is located closer to the <br />lot line than the required setback. Other factors to note: <br />1. The entryway enclosure will create a more energy - <br />efficient home. <br />2. The entryway enclosure will likely not affect any <br />neighbor's views, etc. <br />3. Neither Fox Street or Hanlon Avenue are developed roads <br />at this location, and the applicant has maintained the Fox <br />Street right-of-way as yard area for a number of years, <br />hence the proposed entryway gives the appearance of being <br />setback nearly 60' from the edge of the yard. <br />Planning Commission recommended approval of this application <br />based on the fin -rings and hardships stated above. A resolution <br />is attached. <br />
