Gaffrri, Assistant Zoning Administrator <br />Date: July 16, 1985 ON1133W 11INQ03 <br />Subject: #932 Ward Edwards, 2474 Carman Street - <br />Variance - Resolution <br />Attached is a re -drafted resolution incorporating items <br />discussed during your review of this project on July 8, 1985. <br />The major revisions from the original draft include: <br />Finding No. 5 - Finding that (contrary to the Planning <br />Commission recommendation) area north of the lagoon should <br />be permanently dedicated to the building site. <br />Condition No. 5 - Requiring crediting of lot area to tht. <br />building site as part of any future subdivision. <br />Condition No. 6 - Requiring that the credited land north of <br />the lagoon shall remain as r.on-hardcover. <br />Condition No. 7 - Notifying applicant and future owners that <br />under a future subdivision, the new lot or lots created <br />north of the lagoon will not necessarily be granted riparian <br />lake rights, noting that the intent is to maintain a <br />manageable boat density in the lagoon. <br />In reviewing the discussion that occurred at the July 8th <br />meeting, staff noted the concern on the Council's part that a <br />future Council understand the intent of this Council in granting <br />the variances, but that these actions might not be binding in <br />light of a future Counci l's authcrity to amend these variances. <br />Staff suggests that the format presented here, which makes the <br />area credit and hardcover limitations into actual conditions, and <br />which leaves somewhat open the issue of riparian access, will <br />serve to alert future Councils and staff of your intent with this <br />action. <br />
