Zoning File #852 <br />July 19, 1985 <br />Page 6 <br />Staff would recommend that if the City cnns:ders approving this <br />application as proposed, the City approve only as a test case and that <br />monitoring take place for an unlimited period of time until the City, <br />F.W.B.I. and possibly the U.S. Soils Office agree that under all <br />possible conditions observed at various time intervals, the water <br />quality at the point drainage enters the Lake has not been worsened by <br />alteration. The applicants in turn would have to ar-ee to respond <br />within a reasonable amount of time to a.iy request for physical itera- <br />tion of any of the improvements if those improvements have bf found <br />to h:,ve detrimental effects on the environment or water quality. <br />The City would be looking for the following from the applicant: <br />a) Developer's Agreement - <br />1. Completion of ..,)rk at approved time periods <br />2. Posting of appropriate security so that City can step in <br />and complete if necessary or situation is deemed an <br />e..ergency. <br />3. Payment of fees for the many inspections to be made by <br />Orono staff during construction period. <br />4. Applicant to hire outside agency to perform water <br />quality tests per City's monitoring schedule. <br />5. Writ'-�n confirmation by applicants that F.W.B.I. and <br />U.S. Soi_ Office may perform required tests on site. <br />b) No use of chemical agents in control of algae and aauati( <br />vegetation. In addition the City will ask that all use of <br />fertilizers, hericides and pesticides in areas adjacent to ponds <br />be prohibited. <br />c) City to approve type of dredging to be employed with wildlife <br />restoration. <br />The four attending members f -.-he Planning Commission voted <br />unanimously to approve the cond >ial use permit application of <br />Stanley Gregory to permit the ins,.. lation of a decorative pond and <br />the alteration of a portion of a designated wetland to function as a <br />wildlife pond. This approval is granted on the basis that this pro- <br />jer will serve as a test case for the City to be monitored and <br />observed for an undefined period of time by private consultants and <br />City staff. It should also be understood that in approving this <br />application as a testcase, the City reaffirms its commitment to the <br />protection of the environmental standards and goals as set fortt. i n <br />the comprehensive land use plan of the City. <br />
