City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />C) The existing boathouse on the property is <br />considered a non -conforming structure and subject to <br />the pertinent ordinances. <br />-1. The City Council has considered this application <br />including the findings and recommendations of the Planning <br />Coi,_niss.ion, reports by City staff, comments by the applicant <br />and the effect of the proposed variance on the health, <br />safety and welfare of the community. <br />5. The City Council finds that the conditions existing on <br />this property are peculiar to it and do not apply generally <br />to other property in this zoning district; that granting the <br />variance would not adversely affect traffic conditions, <br />light, air nor pose a fire hazard or other danger to <br />neighboring property; would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONCITIONS <br />Based upon the above findings, the Orono City Cour.,ci 1 <br />hereby grants a variance to the Municipal Zoning Code Section <br />10.22, Subdivision 2 to permit the construction of a garage <br />addition with concurrent removal of existing hardcover resulting <br />in no net increase of hardcover on the property, subject to the <br />following conditions: <br />1. Applicant shall remove a minimum of 450 square feet of <br />existing hardcover exclusive of the area under the proposed <br />garage and backup A;,rcr addition of 450 square feet. <br />2. The applicant is placed on notice that the existing 0- <br />75' hardcover has been calculated at 23.81 where 01 is <br />normally allowed, and that with the proposed additions and <br />removals of hardcover the 75-250' zone hardcover is at 34.5% <br />where only 25% is allowed, and that future proposals for <br />additional hardcover may not be approved. <br />3. The applicant is place? on notice that the existing <br />boathouse structure in the 0-75' zone is considered a non- <br />conforming structure and is subject to the pertinent <br />ordinances. <br />Page 2 of 4 <br />
