MINUTES OF THE: kl:(;U1.11k 01U NO COUNCIL MEETING IfE1.1) JULY 8, 1985. PAGI: 7 <br />ZONING ORDINANCE <br />ISSUES - 6/24/85 <br />attachef,to these minutes), City Administrator Bernhardson <br />reviewed the current ordinance regarding stock farms. It is <br />recommended that any usage by these farms that entails the <br />actual sale of service or commodities and services on sites <br />exceed the intent of the exception and should be done <br />pursuant to the conditional use permit. Bernhardson further <br />stated that their has been a complaint about a farm that <br />existed prior to 1975 operating in violation without a <br />conditional Use permit. This prompted the question of at what <br />point is a conditional use permit required. <br />Counci. 1 member Adams brought up the issue of the limited small <br />scale of ownership of horses which was not addressed in <br />Bernhardsons' report. <br />It was moved by Councilmember Grabek, seconded by Mayor <br />Butler, to accept staffs recommendation. Motion, Ayes (5), <br />Nays (0). <br />Later in the meeting, Earl 6 Betty Dorn of 4045 Watertown Rd. , <br />arrived wishing to add their comments about stock farms. <br />Mr. Dorn felt that there are current violations occurring <br />without conditional use permits. He further stated that <br />studying the ordinance was not. necessary, just simply <br />enforce the current ordinance. <br />Mayor Butler explained to Mr. Dorn that according to staff's <br />report, their are loopholes in the current ordinance making <br />it non -enforceable. She further explained ti,at staff has <br />been instructed to re -draft the ordinance to reflect or,]-,, <br />residential uses and prohibit commercial uses eliminating <br />the loopholes. <br />Again, Mr. Dorn stated that he feels the ordinance should be <br />enforced, as previously done with him, and the City is not <br />doing so. <br />Mr. Dorn was advised that he will be on the Planning <br />Cpmmission Agenda under Public Comments and he could be heard <br />further at that time. <br />City Administrator Bernhardson reviewed his report dated <br />July 5, 1985 (such copy attached to these minutes ) regarding <br />some specific zoning ordinance issues as directed by Counci 1 <br />at the June 24, 1985 meeting. <br />Referring to item B. Non -Conforming Structures Within 0- <br />75,City Administrator Bernhardson questioned whether a <br />variance would be required for lock boxes. <br />Mayor Butler felt that a reign should 1e kept on lock hoxes <br />
