Zoning File #925 <br />Richard & Diane Hennessy <br />4670 Tonkaview Lane <br />May 30, 1985 <br />Page 2 <br />Because this subdivision does not have sewer laterals installed, staff <br />has started to review the possiblity of sewering the properties within the <br />Tonkaview Gardeps plat. As of this writing, City Engineer Glenn Cook, John <br />Gerhardson and I have walked through the area and a number of elevations <br />have been taken, but we have no estimated cost or routing. The other <br />unsewered property owners have been mailed a letter requesting their <br />opinion for or against installing sewer laterals. We have received re- <br />sponses from two property owners. Mrs. Sollner called from Washington <br />D.C., noted that her husband is ill, and they desparately want to sell <br />these properties (but don't want an assessment to make the taxes higher). <br />Mr. Norwood appeared at the Planning Commission meeting, noting that he <br />realized sewer might make the properties more saleable but he was concerned <br />about the up -front costs. He noted he would be a ainst a rezoning to 2- <br />acre unsewered. <br />Planning Commission quizzed the applicant as to whether he understood <br />that if he got approNal now, and built a septic system now, that if sewer <br />comes in he will have to connect and pay for the sewer too. Applicant <br />assured the Planning Commission that he understood the ramifications. <br />Planning Commission unanimously recommended that the variance to allow <br />use of a septic system be granted, based on these findings: <br />1. The property is located in the LR-lB Single Family Lakeshore <br />Residential Zoning District. <br />2. Sewer is not provided to this property although the property is <br />located within Orono's designated sewer service area. <br />3. The costs of providing a municipal sewer lateral to serve this <br />property and the adjacent undeveloped properties has not been deter- <br />mined; the City has no indication when the neighboring properties will <br />be developed. <br />4. The property can support primary and alternate mound type septic <br />systems. <br />5. The property can gain access through the undeveloped Garden Lane <br />right-of-way. <br />6. The applicant has demonstrated that he is aware of the potential <br />for sewer to be installed in the area, and is aware that he risks <br />paying tor a septic system and a sewer. <br />Approval should be based on the following conditions: <br />1. Applicant shall locate the house such that the house and driveway <br />do not encroach onto the approved drainfield sites. <br />
