City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.20, SUBDIVISION 3 (E) <br />FILE NO. 933 <br />WHEREAS, Ned Butterfield (hereinafter "the applicant") <br />has an interest in the property located at 374: Watertown Road <br />within the City of Orono (hereafter "City") and legally described <br />as follows: <br />The east 196.5 feet of the weep 392.98 feet of the southeast <br />quarter of the southwest quarter of Section 32, Township 117 <br />north, Range 23 west of the 5tY principal meridian, Hennepin <br />County, Minnesota (hereinaf—r. "property"); and <br />WHEREAS, the applicant has applied to the City for a <br />Conditional Use Permit to permit the construction of a 40' x 100' <br />commercial greenhouse per Municipal Zoning Code Section 10.20, <br />Subdivision 3 W. <br />FINDINGS <br />1. This application was reviewed as Zoning File No. 933. <br />2. The property is located in the RR-lA Single Family Rural <br />Residential Zoning District. <br />3. On June 17, 1985, the Orono Planning Commission reviewed <br />the application as proposed and recommended approval, <br />finding that: <br />e ) A commercial gtcenhcuse operation has existed on <br />this property since prior to the 1967 zoning code. <br />b) The City Council formally recognized this <br />commercial greenhouse and wholesale/retail commercial <br />flower operation through a non -conforming conditional <br />use permit dated September 13, 1968. <br />c) The retail sale of flowers o:. the property has <br />nearly ceased to exist in recent years. The whole- <br />sa le/retai 1 sa le of f lowers on the propertv wi 11 not <br />increase as a result of the additional greenhouse <br />structure, hence, this is not considered as an expan- <br />sion of a non -conforming use. <br />Page 1 of 4 <br />
