City of OR ONO <br />RESOI UTION OF THE CITY COUNCIL <br />NO. <br />A) The contiguous dry buildable area or building <br />envelope is less than 1/2 acre but subject to two acre <br />developement standards. <br />B) The majority of the lot =s a 2 1/2 acre wetlands <br />that serves as a retention a i for surrounding neigh- <br />borhood. <br />C) Sewer service was approved for the property in 1980 <br />and the same codes .are in affect for this review. <br />D) The proposed house is consistent with older <br />developed lots on north side of road where majority of <br />lots also have extensive wetlands and restricted <br />building envelopes. <br />E) An error was made in the original resolution ap- <br />proving sewer for the site because the area cal- <br />culations were incorrect and the code would have deemed <br />the lot unbuildable. <br />F) Most affected owner finds no problem with location <br />of principal location. <br />4. The City Council ha- -:onsidere, this application <br />including the findings a..j recommendations of the Orono <br />staff and the effect of the proposed variance an the health, <br />safety and welfare of the community. <br />5. The City Council f i -ds that the conditions existing on <br />this property are pecul . to it and do not apply generally <br />to other property in thi_, zoning district; that grantin lie <br />variance would not adversely affect tray` - cc,;dit, s, <br />light, air nor pose a fire hazard or r danger to <br />neighboring property; would not mer. serve as a <br />convenience to the applicant, but is necessary to alleviate <br />a demonstrable hardship or difficulty; is necessary to pre- <br />serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning <br />Code and Ccmprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based <br />upon the <br />above findings, the Orono City Council <br />hereby <br />grants a <br />variance to the Municipal Zoning Corse Section <br />10.21, <br />:;�jhdi vision <br />6 (B) <br />to permit. the construction of a p. i n- <br />cipal <br />resit:once <br />37 feet <br />from the rear lot line instuad. of tho <br />required 50 feat <br />subject <br />to the fcl luw;r,q corl(10 ions: <br />I aqe 2 O` 4 <br />
