City of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />A RESOLUTION GRANTING <br />A VAPIANCE TO <br />MUNICIPAL 'ZONING CODE <br />SECTION 10.21, SUBDIVISION 5 (B) <br />FILE #911 <br />WHEREAS, Timothy J. Schoen (hereinafter "the <br />applicant") has an interest in the property located at 41 Willow <br />Drive North within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 12, Block 3, D,.::iels Long Lake Heights (hereinafter "the <br />property"); and <br />WHEREAS, the applicant has applied to the City foi a <br />variance to Municipal Zoning Code Section 10.21, Subaivision 5 <br />(B) to allow construction of a new residence on a lot 17,366 <br />.square feet in area instead of the required 21,780 square feet. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #931. <br />2. The property is located in the R-lB One Family <br />Residential District. <br />3. The Orono Iff has reviewed this applicati-- and <br />recommends appro. of the proposed lot area variance based <br />upon the for owing findings: <br />A) The area of the applicant's lot is consistent witl- <br />the areas of the majority of the neveloped ')ts withi! <br />Daniels Long Lake Heights plat. <br />B' Per Section 10.03, Subdivision 6 (A),(1) if tho lot <br />contai.•ieJ 17,424 square feet or 60% of the r( lu red <br />area, the applicant would not have had to seek <br />Council's approval to build on the property.
