The fence would <br />appear to measure between 5 to 6 feet in height above existing <br />grade, placed approximately 20 to 25 feet from the shoreline and <br />at the edge of the newly defined right-of-way of County Road 15 <br />that intersects your lakeshore lot. I cite for your con- <br />sideration Section 10.22, Subdivision 1 as amended by Council on <br />January 5, 1985: <br />Subdivision 1. Lakeshore Set Back Regulations. The set <br />back from the shoreline for lakeshore lots shall be at least <br />75 feet and no building, fence or wall over forty-two inches <br />but not in excess of seventy-two inches in height above <br />ordginal grade may be located closer to the shoreline than <br />the average distance from the shoreline of existinq <br />residence buildings on adjacent lots. <br />Although, I have not discussed this matter with you, it <br />would be my guess that you erected the fence per newly amended <br />Section 10.03, Subdivision 15 (C) that you helped author as <br />follows: <br />C.
