CITY of ORONO <br />P•,I Ofrin Boa SS•Cgaal B•y, Mlnneeole 5 M-M...6,0 Omm <br />On the North Shore of Lake Minnetonka <br />May 20, 1985 <br />George Rovegno, Jr. <br />2010 Shoreline Drive <br />Wayzata, MN 55391 <br />Dear George: <br />Unfortunately, I must send this letter to advise that the <br />fence erected in your lakeshore yard on or about May 11, 1985 is <br />in violation of the Municipal Zoning Code. The fence would <br />appear to measure between 5 to 6 feet in height above existing <br />grade, placed approximately 20 to 25 feet from the shoreline and <br />at the edge of the newly defined right-of-way of County Road 15 <br />that intersects your lakeshore lot. I cite for your con- <br />sideration Section 10.22, Subdivision 1 as amended by Council on <br />January 5, 1985: <br />Subdivision 1. Lakeshore Set Back Regulations. The set <br />back from the shoreline for lakeshore lots shall be at least <br />75 feet and no building, fence or wall over forty-two inches <br />but not in excess of seventy-two inches in height above <br />ordginal grade may be located closer to the shoreline than <br />the average distance from the shoreline of existinq <br />residence buildings on adjacent lots. <br />Although, I have not discussed this matter with you, it <br />would be my guess that you erected the fence per newly amended <br />Section 10.03, Subdivision 15 (C) that you helped author as <br />follows: <br />C. Fences which do not exceed 3 1/2 feet in height, feI <br />not over six feet in height along the street lot line <br />lake frontage lots which front on a naior thoroughfare <br />crown or the roam terraces, steps, uncoverea porches, <br />stoops or eIm—ilar structures, which do not extend above the <br />height of the ground floor level of the principal building <br />and extend to a distance of not less than two feet from any <br />lot line. <br />Your <br />lot, your neighbors' lots -all lots <br />adjacent <br />to the <br />shores of <br />Lake Minnetonka, where County roads, <br />private <br />roads, <br />easement <br />roads intersect lakeshore yards, are <br />subject <br />to the <br />standards <br />of our code that protect and assure the viewing <br />rights <br />of lakeshore lot owners, <br />OCaalNU A rnNINU <br />- IFS )nT • AaKINISTKATION A I INANQ - OS )SSe <br />• el ILK MU•KS 471 <br />ASSLSSINa <br />
