1� <br />* CONDITIONS OF THE. CONTRACT <br />SECTION 1 <br />DEFINITIONS <br />1.1 ACTS OF GOD <br />An Act of God is an unusual, extraordinary and sudden manifestation of the <br />forces of nature, uncontrolled and uninfluenced by the power of man and with- <br />out human intervention, that could not under normal circumstances have been <br />anticipated or expected. Ordinary weather conditions of .•Drmal intensity for <br />the locality shall not be considered as an Act of God. <br />1.2 ADDENDA <br />Written or graphic instruments issued prior to the opening of Bid6 which <br />clarify, correct or change the bidding documents or the Contract Documents. <br />1.3 AGREEMENT <br />The Agreement is the written document executed by the Owner and Contractor <br />covering the performance of the Work described in the Contract Documents. <br />1.4 BID SECURITY <br />' The Bid 'L,rity, where required by the Advertisement or Information to Bid- <br />ders, is a cashier's or certified check, cash or Bid Bond accompanying the <br />Proposal submitted by the bidder, pledging that the bidder will enter into an <br />' Agreement with the Owner for the carrying out of the Work, should the contract <br />for the Work be awarded to him. <br />1.5 BIDDER <br />A Bidder is an individual or other entity submitting a Proposal for the adver- <br />tised Work. <br />1� <br />1.6 CONTRACT <br />The Contract Documents form the Contract. The Contract represents the entire <br />and integrated agreement between the parties hereto and supersedes all prior <br />negotiations, representations, or agreements, either written or oral. <br />1.7 CONTRACT DOCUMENTS <br />The Contract Documents consist of the following, including all Addenda issued <br />prior to the opening of bids, Field Orders, Change Orders or other Modifica- <br />tions issued after execution of the Agreement: <br />r <br />h1/85 - 8505b <br />Copyright 1965 <br />Bonestroo, Ro8one, A,vlerlik <br />6 Associste9 Inc. <br />
